CONSUMER TERMS OF SALE
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE
Format of the Contract
These terms of sale apply to all goods supplied by Unlocked Dongle via www.unlocked-dongle.com The website is governed by the following terms and conditions; they do not affect your statutory rights.
Any order placed by you for goods advertised on our website is an offer by you to purchase the goods selected in your order. No contract exists between you and us for the sale of any goods until we have received your order and accepted it (which we may do at our discretion). We will send you an order acknowledgement shortly after you place your order, notifying you that we have received your order. This acknowledgement is not notification that we have accepted your order.
Unlocked Dongle may change these terms of sale without notice to you in relation to future sales.
Description and price of the goods
We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. We provide you with product information on unlocked-dongle.com If there is anything which you do not understand, or if you wish to obtain further information, please contact our Customer Services team on: firstname.lastname@example.org
Every effort is made to ensure that prices shown on unlocked-dongle.com are accurate at the time of placing your order. If, by mistake, we have under priced an item we will contact you and offer you the following three options:
- placing a new order at the correct price for those goods;
- cancelling the whole of your order; or
- Cancelling your order for the mis-priced goods and reconfirm your order for the correctly priced goods.
If you do not choose one of the 3 available options within 14 days, your order will be cancelled or the under priced item will be removed from your order. If any payment has been made by you, you will be credited back to your original payment method.
1. Price and payments
The price for the service shall be the quoted price of the seller, and payment of the price shall be made by the buyer before provisioning of the service.
The description and quality of the service to be sold (the service) shall be as set out in the description provided by the seller to the buyer (the description) at product detail page.
The seller shall deliver the service to the buyer at the email address of the buyer as shown on the buyers submission. Time shall not be of the essence for delivery.
4. Title and risk
4.1. The service shall be at the risk of the buyer following delivery.
4.2. Notwithstanding delivery, title in the service shall not pass to the buyer until the buyer has made payment of all sums owing to the seller.
4.3. Until such time as title in the service passes to the buyer, the seller shall have the right to withhold the service.
The sale of service on the unlocked-dongle.com website is final. The customer is expected to research all aspects of a service capabilities before making a purchase. By purchasing service on the unlocked-dongle.com website the customer agrees that he has accepted and understood the service capabilities and capacity to carry out the specific operation for which it is intended. Further, no refunds can be offered or given to customers after the purchase of service in a case where the customer decides that the service cannot fulfil their expectations. A refund may be considered if the service fails to function in part or completely. However the customer may be required to provide video evidence showing the service failing to function before a refund will be considered. Unlocking your modem does not guarantee that it will work with a particular mobile network.
6.1. The seller is not responsible for any errors the customer makes in providing his/her IMEI, his/her current network service, or in entering the unlock codes given, or if someone else has previously been unsuccessful in attempting to unlock customers modem or phone. Due to all these factors beyond sellers control, the seller can't 100% guarantee the unlock codes he provides.
6.2. The seller can only guarantee that the service will fulfil the customers expectations if the following criteria are met:
• the information provided on the submission form when ordering the service is 100% correct
• the instructions provided with the service have been followed exactly as stipulated
• the target modem or mobile phone is not stolen or blacklisted
• the target modem or mobile phone is not already unlocked
• the software of the target modem or mobile phone has never been altered, changed or tampered with in any way
• the IMEI number of the target modem or mobile phone (Your IMEI code is the modem’s \ phone’s unique electronic serial number. It has 15 digits. It might be printed somewhere on the modem or phone, probably underneath the battery) has never been altered, changed or tampered with in any way
• the modem or phone has never undergone an attempted unlocking with codes in the past.
A refund shall not be warranted if all of these criteria are not met.
6.3. Seller will endeavour to solve any problem a customer may have while attempting to use sellers service, however liability for the success of the service lies solely with the consumer.
6.4. Furthermore, seller cannot guarantee that the service will enable the device to operate on any specific network. Certain handsets \ modems will only operate on certain networks. This is due to different network frequencies.
7. Incorrect Orders
It is the customers responsibility to make sure that the target modem or phone and the network the mobile modem or phone is currently locked to is supported by sellers service. A credit note may be offered in specific circumstances, however a refund cannot be offered or given where the customer has paid and subsequently discovered that their handset and/or network is not supported by sellers service.
8. Refund Policy
8.1. In the unlikely event that the codes the seller provides fail to unlock a customers modem or mobile phone, the seller will ask the customer to confirm that the details they provided when submitting the order are 100% correct. In the event that the customer confirms that the submitted details are 100% correct, the seller reserves the right to seek further evidence to support the customers claim that the codes did not unlock their modem or mobile phone. This may include the customer sending the modem or mobile phone to the seller for verification purposes or making a video recording containing images of the modem or phone in question, the IMEI number on the sticker in the rear of the modem or phone in question, the IMEI number displayed on the screen of the modem or phone in question and the customer inserting an alternative SIM card and the resultant screen of the modem or phone in question after it is switched on with the alternative SIM card inserted. These measures may seem a little extreme to most, however due to the electronic nature of sellers business, seller has no other way to determine whether an unlock has been successful or not. By using sellers site or sellers service, buyer (customer) is agreeing to these article of agreement in full.
8.2. Order cancellations shall only be considered, if the order placed has not commenced processing. Customer can contact seller with their order identification number first to check if their order has been processed or not.
8.3. Unlock codes issued by the seller for modem & mobile phones that turn out to be barred (stolen modems or phones or modems or mobile phones that were reported lost by the owner) or blacklisted, are not eligible for refunds. Refund will not be given in these cases.
8.4 A Refund will be offered (if eligable) up to 28 days from the purchase date, after which time store credit may be offered at our discretion.
The 100% money back guarantee:
We will require evidence that the unlock has failed to work. This is usually in the form of a screen grab showing the unlock status of the device.
The guarantee does not apply if:
a) It does not apply if a customer has purchased the incorrect unlock. Please be very careful when selecting the modem you require unlocking! Many modems have very similar model names \ numbers.
b) It does not apply if the modem has exceeded its maximum unlock attempts.
c) It does not apply to modems that have been blocked by the network.
d) It does not apply to damaged or faulty modems.
e) It does not apply if the modem is already unlocked
f) It does not apply if the modem has not been installed correctly e.g. software drivers have not been installed or any other essential software required for the computer and modem to communicate is not installed or not working correctly
g) It does not apply if the customer doesn’t have all the specified requirements, see below.
a) The customer will require software that allows them to extract Zip files
b) The customer must have access to an internet connection, this can’t be via a mobile broadband connection.
c) A Microsoft Windows based PC
d) The customer must make sure that the PC and modem are correctly communicating and functioning before purchasing an unlock.
e) Unlocked Dongle are unable to offer assistance with third party software e.g. connection managers, zip utilities, anti virus software, firewalls etc
Unlocked Dongle is only able to offer support in getting the modem unlocked using the solution we supply.
When a customer purchases either an unlock code or the unlocking software they are purchasing the unlocking solution only. The configuration settings, utilities and software that Unlocked Dongle supplies is to help the customer as a ‘value added’ service and no support or guarantee is supplied as part of the purchase.
Our support services are only available for 28 days after the purchase date, after which time it is at our discretion to offer extended support.
It is the customer’s responsibility to make sure that they have a backup of their systems. Unlocked Dongle and any software or services recommended cannot be held responsible for any failures or loss of data that may occur.
The methods used by Unlocked Dongle to unlock mobile devices are very safe and unlikely to cause any problems. Unlocking a device is carried out at the owners risk! Unlocked Dongle will not be held responsible for any failures or problems resulting of the unlocking process.
9. Order verification prior to processing
9.1. In certain cases, the seller may ask the customer to submit a scanned copy of the credit card and bank statement in order to completely verify the integrity of the order and to avoid credit card fraud.
9.2. The seller reserves the right to refuse an order which looks suspicious or turns out to be fraudulent.
9.3. Orders which turn out to be fraudulent will be reported to the relevant authorities to be investigated to the fullest extent by law.
10. Force majeure
The seller shall not be liable for any default due to any circumstance beyond the reasonable control of the seller including, but not limited to, acts of god, war, civil unrest, riot, strike, lock-out, acts of civil or military authorities, fire flood, earthquake or shortage of supply or failure to deliver of the suppliers of the supplier.
11.1. The seller draws customers attention to that modem & mobile phone software customisation may invalidate customers modem or phones manufacturers warranty. The seller is not responsible for any damage caused to customers modem or mobile phone.
11.2. The customer should make sure it is legal to unlock his/her modem or mobile phone in the country he/she reside in.
12. Legal Liability
In accordance with legal regulations the seller provides a service to unlock modem or mobile phones for the sole purpose of lawfully connecting to a wireless telephone communication network. Any other use or misuse of a modem or mobile phone that is unlocked using sellers service is in no way sellers responsibility. By making a purchase of any unlocking service on sellers website the buyer agrees to accept full legal liability for his/her actions, use, misuse, sell, financial gain, or transfer of the modem or mobile phone.
13. General conditions
13.1. If any term or provision of these general commercial terms and conditions (Conditions) is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
13.2. The seller may without the consent of the buyer sublicense its rights or obligations or any part of these Conditions.
13.3. The headings in these Conditions are for ease of reference only and shall not affect the interpretation of any of the Conditions.
14. Entire agreement
Each of the parties agrees that save in respect of statements made fraudulently it shall have no remedy in respect of any untrue statement upon which it relied in entering this agreement and that its only remedies shall be for breach of contract
15.1. The seller is committed to protecting customers privacy. The seller will only use the information that he collect about the customer lawfully. The customer will never collect sensitive information about the customer without customers explicit consent. The personal information which the seller holds will be held securely in accordance with his internal security policy and the law.
15.2. The seller is allowed to collect this information about customer Information you provide When you sign up for unlocked-dongle.com account we ask you for personal information (email, name, password).
When you access unlocked-dongle.com, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.
When you submit an IMEI number it will be recorded in our system
When you send email or other communications to Google, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
15.4. We restrict access to personal information to Unlocked Dongle employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
15.5. Customer has the right to request a copy of the personal information we hold about you. Please address requests to us at email@example.com
Although all attempts are made to provide accurate, current and reliable information, you should recognise the possibility that errors may exist in the information available on this Web site. Unlocked Dongle expressly denies any warranty of the accuracy, reliability, or timeliness of any information made available on this Web site, and shall not be held liable for any losses caused by reliance upon the accuracy, reliability, or timeliness of the information. A person who relies upon information made available on this Web site does so at the persons own risk.
Before following any advice or installing any software or hardware recommended or mentioned on this site, you are strongly encouraged to do a full backup of your data and system. Unlocked Dongle shall under no circumstances be responsible for data loss or system failure.
